3.3 Payment Information

  • Transaction references and payment confirmations.

ASF does not collect or store sensitive financial credentials such as full card numbers, CVV, UPI PIN, or banking passwords. All payments are processed through secure third-party payment gateways.

3.4 Service and Communication Records

  • Session schedules, attendance and check-in records;
  • Communication records, service preferences, feedback, and testimonials.

3.5 Technical and Usage Information

  • IP address, device and browser details;
  • Website usage data, server logs, and cookies or similar tracking technologies.

3.6 Media and Transformation Content

  • Photographs, videos, transformation images, progress visuals, and related content voluntarily provided by you or generated during your engagement with ASF.

3.7 Lead Information

Information submitted through social media lead forms (such as Facebook or Instagram), search-engine advertising lead forms, Website enquiry forms, or WhatsApp, call, or manual enquiries.

4. Purpose of Data Usage

We collect and process personal information for purposes including, but not limited to:

  • Contacting you regarding fitness programs, consultations, and Services;
  • Providing coaching, training, nutrition guidance, support, and assigning suitable coaches;
  • Designing personalised workout, nutrition, and lifestyle plans;

  • Sending transactional, service-related, and (where consented) promotional communications;
  • Internal operations, analytics, scheduling, training, safety, and performance management;
  • Fraud prevention, dispute handling, documentation, and security; and

5.Lead Collection and Communication Consent

5.1 By submitting your details through any form, advertisement, or platform, you provide informed consent for ASF to contact you via telephone calls, WhatsApp messages, SMS, and email, for the purpose of responding to your enquiry and providing information about the Services, follow-ups, and consultation calls.

5.2 Submission of your personal information through any ASF form or channel constitutes valid consent under applicable law for ASF to contact you in connection with your enquiry and the Services.

5.3 You may withdraw your consent to promotional communications at any time by contacting ASF through the official channels listed in this Policy. Withdrawal of consent will be processed within a reasonable timeframe and will apply prospectively. Certain essential service-related communications may continue where necessary for the performance of an active Program.

6.Cookies and Tracking Technologies

6.1 The Website uses cookies, analytics tools, server logs, and similar technologies to support website functionality, analyse traffic, improve user experience, deliver and measure advertising and remarketing, and maintain security and fraud prevention.

7.2 ASF may share personal information only to the extent reasonably necessary, with: (a) internal staff and coaches, for service delivery, scheduling, and coordination; (b) third-party service providers such as customer-relationship-management, analytics, and payment-gateway providers; (c) advertising platforms, for lead management and remarketing; and (d) legal, regulatory, or government authorities, where required by applicable law.

7.3 All such sharing is limited to the necessary purpose and is subject to appropriate confidentiality obligations.

7.4 Internal Access Limitation. Access to personal information within ASF is restricted to authorised personnel, coaches, and operational representatives who reasonably require such access for legitimate business, coaching, support, compliance, or service-related purposes.

8. Recording, Media and Transformation Content

8.1 ASF may record, monitor, or review certain online or offline sessions, consultations, and training interactions strictly for internal training, quality control, performance monitoring, safety, and documentation purposes.

8.2 ASF may collect or obtain progress photographs, transformation records, testimonials, feedback, and assessments for internal tracking, quality control, service improvement, and — where applicable — educational, branding, and promotional purposes.

8.3 Where applicable, ASF may use limited portions of session content, transformation visuals, photographs, testimonials, screenshots, or short clips through its official website, social media channels, advertisements, educational materials, and presentations, in a professional, lawful, and non-misleading manner. ASF will make reasonable efforts to ensure that such usage remains appropriate and aligned with legitimate operational, educational, branding, or promotional purposes.

9. Photo, Video and Content Usage Rights

9.1 By using the Services, you grant ASF a worldwide, royalty-free, non-exclusive licence to use content generated during your engagement — including photographs, videos, transformation images, testimonials, and feedback — for the purposes described in Clause 8.

9.2 Such content may be used on the Website, on social media, in marketing and advertising, and for educational purposes, in a professional and lawful manner.

9.3 You may withdraw your consent to the future use of such content by submitting a written request through the official channels in this Policy. Withdrawal will apply prospectively: ASF will cease further use of the relevant content within a reasonable period but shall not be obliged to recall, retract, or remove content already lawfully published or distributed prior to the withdrawal request.

9.4 Objection and Content Removal Requests If you object to the publication of your photographs, videos, testimonials, or other promotional content, you must notify ASF in writing within 7 (seven) calendar days from the date the content is first published.

Upon receiving a valid request within this period, ASF will make reasonable efforts to remove or discontinue the future use of the content, subject to technical and operational feasibility.

Requests submitted after the 7-day period or after the content has been incorporated into ongoing marketing campaigns, printed materials, advertisements, or other promotional assets may require additional production, editing, or replacement work. In such cases, ASF reserves the right to recover the reasonable costs incurred for content editing, redesign, replacement, or campaign modification. Any applicable charges will be communicated to the client and must be approved before the work is carried out.

The removal of content will apply prospectively only and shall not require ASF to recall, retract, or remove materials that have already been lawfully published, distributed, printed, or used before the request was received.

 

10. Health and Wellness Disclaimer

10.1 Any health, fitness, dietary, or lifestyle information that you share with ASF is provided voluntarily and at your own discretion.

10.2 The Services are intended solely for general fitness, wellness, lifestyle, and educational purposes. They do not constitute medical advice, diagnosis, treatment, or healthcare supervision. You are advised to consult a qualified medical professional before making any health-related decision.

10.3 While ASF takes reasonable measures to protect the confidentiality of such information, ASF shall not be liable for any unauthorised disclosure, misuse, or breach arising from third-party systems, user negligence, cyber incidents, or other circumstances beyond its reasonable control.

11. Communication Platforms

11.1 You acknowledge that communication with ASF may take place through third-party platforms, including WhatsApp, telephone, SMS, email, video-conferencing applications, and messaging services.

11.2 While ASF makes reasonable efforts to use reliable platforms, ASF shall not be liable for unauthorised access, technical failure, interruption, data breach, recording, or misuse occurring through any third-party communication platform beyond its reasonable control.

12. Data Security

12.1 ASF implements reasonable administrative, technical, and organisational safeguards intended to protect personal information against unauthorised access, misuse, disclosure, alteration, or loss.

12.2 However, no system, server, or method of electronic transmission or storage is completely secure. ASF does not guarantee absolute security and shall not be liable for breaches arising from external factors, third-party platforms, or user negligence beyond its reasonable control.

13.1 ASF retains personal information only for as long as reasonably necessary for service delivery, legal and regulatory compliance, dispute resolution, documentation, and legitimate business purposes.

13.2 ASF may retain minimal records for record-keeping and legal-defence purposes even after the completion of your engagement.

14.1 The Services may involve third-party facilities, websites, applications, gyms, fitness centres, payment gateways, and communication platforms. ASF is not responsible for the privacy practices, policies, security standards, acts, or omissions of such third parties, and you interact with them at your own discretion and risk. 14.2 Certain communication platforms, cloud services, storage systems, analytics tools, or payment gateways used by ASF may operate on servers located outside India. By using the Services, you acknowledge and consent to the processing, storage, or transfer of your information through such systems, subject to applicable security practices.

15. Your Rights

Subject to applicable law, you may:

  • Request access to the personal information ASF holds about you;
  • Request correction or updating of inaccurate or incomplete information;
  • Withdraw consent, subject to reasonable processing timelines and the limitations in Clauses 5 and 9; and

  • Never sharing OTPs, passwords, or sensitive access information with any person;

ASF shall not be liable for any loss arising from your negligence or from unauthorised actions carried out using your credentials.

17. Children and Minors

17.1 The Services are intended for individuals who are at least eighteen (18) years of age and legally capable of entering into a binding agreement.

17.2 Where Services are provided to a minor, the consent, supervision, and responsibility of a parent or legal guardian are required.

18. Account Restriction and Suspension

ASF reserves the right to suspend, restrict, terminate, or deny access to any account, content, or Service in the event of: violation of this Policy or the Terms & Conditions; misconduct or abusive behaviour; fraudulent activity; defamation or reputational harm; unauthorised recording, sharing, or misuse of ASF materials; or security or operational concerns.

To the maximum extent permitted by applicable law, ASF shall not be liable for: unauthorised access caused by external factors beyond its reasonable control; data breaches originating from third-party platforms; or any loss arising from user negligence in protecting personal information or credentials.
